Nintendo has won a long -standing legal battle against the French Sharehosting operator Dstorage.
After a decision dated February 26, 2025, the French Supreme Court found Dstorage “responsible for not eliminating access to unauthorized copies of the Nintendo games stored on its platform”, referring to the Filehosting 1Fichier.com site.
This decision means that other fiction sites based in Europe must eliminate pirate games of games when asked, or face legal actions and potential fines.
Initially, Nintendo filed a lawsuit against Dstorage in 2021, after having previously demanded that the company demolished the unauthorized Nintendo games stored at 1FFIER.com.
Dstorage appealed the decision, which failed when in April 2023 the Paris Court of Appeals ordered the company to pay Nintendo € 422,750 in compensation and € 25,000 in legal fees.
Dstorage then brought the case to the French Supreme Court, claiming that a court order was needed before eliminating the pirated content. This finally failed, which led to Nintendo’s victory in the Court.
“Nintendo is satisfied with the court’s discovery against Dstorage and believes that it is significant not only for Nintendo, but for the entire games industry,” the firm said.
“He will ask that shatsters such as 1phier.com claim as he did during the procedures on the merits that a prior decision of a court is needed before the pirated content must be withdrawn, and confirms the rights that the holders must notify when claiming that the content notifies infringes the copyright or the rights of trademarks.”
He added: “Together with his recent decision as of January 15, 2025, confirming that an important French bank had legitimately ended a payment processing agreement with 1FFIER.com due to the lack of anti -proven measures, the French Supreme Court leaves no doubt that shares such as 1phier.com are not a safe shelter for storage and sharing illegal content.”
Nintendo has been taking energetic measures against piracy lately. In November, he asked a district court in the United States that cited commercial records of several companies as part of their lawsuit against James ‘Archbox Williams’ for alleged piracy changes.
He has also sought legal actions against Ryan Michael Daly of Modded Hardware, a website that sells modified consoles, pirate games and mods chips.
In February 2024, Nintendo filed a lawsuit against the creators of the Switch Yuzu emulator. A month later, its developer Tropic Haze agreed to pay $ 2.4 million in an agreement and resigned from the domain name to Nintendo of America.
Later that year, the Switch Ryujinx emulator, according to the reports, ended the development after an application made by Nintendo.
